 Mahfud's Warning to BLBI Obligors


Coordinating Minister for Political, Legal, and Security Affairs Mahfud MD revealed the latest update regarding the institution of the Task Force for Handling State Collection Rights for BLBI Funds. One of them relates to the latest presidential decree related to the BLBI Task Force.

"In this new presidential decree, there is the name Kabareskrim, entered here because if there is a criminal problem it will be handled immediately. What is the criminal problem, for example? The land has been legally resolved to the state, suddenly it is sold with fake documents and so on, which will be criminal. The state will intervene with the Criminal Investigation Agency, Jamdatun, and the Attorney General's Office," said Mahfud MD after chairing the BLBI Task Force meeting at the Coordinating Ministry for Political, Legal, and Security Affairs office, Thursday (7/10/2021).

Meanwhile, according to him, if the BLBI Task Force encounters problems related to land, whether certificates or other administrative issues, the Minister of ATR/BPN will immediately handle it.

The BLBI Task Force was formed in the context of handling and recovering state rights in the form of state collection rights for remaining state receivables from BLBI funds and property assets. Although basically a civil matter, criminal problems may also arise.

"We are indeed under civil pressure. But I have been provided with two presidential decrees, the task force on state collection rights for the BLBI was first, the first capital was to take steps, it turns out that in the middle of the road, there may be other legal steps taken so that I am capitalized on a new presidential decree Another one, which was just published on Wednesday, October 6," said Mahfud, quoted from a press release from the Coordinating Ministry for Political, Legal and Security Affairs. So far, according to him, there have been several positive steps, such as ensuring assets that must be controlled by the state, then confiscation. money. According to Mahfud, most of those called by the BLBI Task Force came and committed to paying.

Mahfud emphasized that in carrying out various efforts to handle, settle, and restore state rights, the BLBI Task Force will take firm action for obligors who are not serious about fulfilling their obligations.

"All of this later, when it comes to claims, the state may confiscate it. If it has been summoned, continue to provide information and then ensure that we have debt records. If we don't want to settle it properly, we will confiscate it. There may also be a criminal problem," he said. For this reason, Mahfud requested that obligors cooperate in returning their obligations to the state, especially in the current conditions.

"I want everyone to cooperate, to return their debts to the state. Because the state now needs to be returned to the people. It is used for the benefit of the people, which is the duty of the state. There will be further steps later," he said.

Chasing Bills, BLBI Task Force Confiscates Money, Land To Buildings

Chairman of the Task Force on the Rights to Collect Bank Indonesia Liquidity Assistance, Ronald Silaban, said that he was continuing to summon BLBI obligors/debtors. Not only that, asset confiscation also continues to be carried out as a form of debt rather than the obligor/debtor.

According to him, until now the confiscation of assets in the form of money has been carried out on Kaharudin Ongko with a value of more than Rp 100 billion. It is known that Ongko has a BLBI-related debt of Rp. 8.2 trillion. The Director-General of State Assets said that most of the confiscations were carried out for building and land assets. The confiscation process continues to be carried out on obligors/debtors who have receivables.

"Of the other obligations, most of them are land. What we also have to do is block assets massively," he said.

According to him, the blocking is done to ensure that assets that have been given as debt guarantees to the Government cannot be transferred to other people. This reflects on the assets in Lippo Karawaci Housing some time ago which were handed over to the government but were used by third parties.

"Because indeed, since the asset was given, we also know that there are many problems. To ensure that the property assets or the collateral assets cannot just be transferred, the team has made a blocking request," he explained.

The number of blocks against the use of assets by third parties is said to be quite large. However, he could not specify in detail which assets and whose property was blocked.

"The number is very massive, I don't remember the details, but every day I always get requests to block them. It's all in the Menkopolhukam report to the President," he said.
